These Terms of Service ("Terms") govern your use of DocPing — a WhatsApp-based appointment booking service for clinics, operated by Aniket Pathak from Pune, Maharashtra, India ("we", "us", "our"). By messaging our bot or using any clinic page hosted by us, you agree to these Terms.
1. The service
DocPing lets patients book, reschedule, and cancel clinic appointments through WhatsApp, and lets clinic providers receive instant notifications about those bookings. We do not provide medical advice, diagnosis, treatment, or emergency services.
For medical emergencies, call 112 (India national emergency number) or go to the nearest hospital. Do not rely on DocPing.
2. Eligibility
- You must be 18 years or older, or a parent / legal guardian booking on behalf of a minor
- You must have a valid WhatsApp account on a phone number you control
- If you are a clinic, the person setting up the bot must be authorised to act on the clinic's behalf
3. Your obligations as a patient
- Provide accurate information when booking (name, phone, slot)
- Do not book appointments you do not intend to attend (it harms other patients waiting for the slot)
- Cancel or reschedule with reasonable notice if your plans change
- Do not abuse, harass, or send spam to the bot
- Do not attempt to reverse-engineer, probe, or attack the service
4. Your obligations as a clinic
- Provide accurate clinic information (name, hours, doctors, services)
- Honour confirmed bookings; if you cannot, notify the patient promptly via the same WhatsApp thread
- Do not use DocPing for marketing blasts or non-appointment messaging
- Comply with India's medical and pharmaceutical advertising regulations and the DPDP Act for any patient data you handle on your end
- Pay subscription fees on time (if on a paid plan)
5. Pricing & pilot
We currently offer a free 30-day pilot to a limited number of clinics. After the pilot, paid plans start at ₹499/month. Pricing, features, and limits may change with 30 days' notice — we will WhatsApp you before any change takes effect.
Patients always use DocPing for free; the clinic pays the subscription.
6. Account & access
Clinics receive admin access to the booking dashboard. You must keep your login credentials secure. Notify us immediately if you suspect unauthorised access. We may suspend access if we detect abuse, fraud, or breach of these Terms.
7. Acceptable use
You agree not to use DocPing to:
- Send unsolicited marketing or spam
- Impersonate another person or clinic
- Upload or share illegal, defamatory, or hateful content
- Circumvent rate limits or technical safeguards
- Resell access to the service without our written permission
Violation may result in immediate suspension or termination of your access with no refund of any pre-paid fees.
8. WhatsApp & third-party services
DocPing runs on top of Meta's WhatsApp Business API. Your use of the bot is also subject to WhatsApp's Business Messaging Policy and WhatsApp Business Terms of Service. We are not responsible for outages, throttling, or policy changes on Meta's side.
9. Service availability
We aim for high availability but we do not guarantee 100% uptime. The service may be unavailable due to maintenance, third-party outages (Meta, Render, telecom carriers), force majeure, or technical issues. Critical appointments should always be confirmed by the clinic directly.
10. No medical liability
DocPing is a scheduling tool, not a medical service. We make no representation about the quality, safety, or efficacy of any treatment provided by clinics on our platform. Any patient–doctor relationship is exclusively between you and the clinic. We are not liable for medical outcomes, missed diagnoses, treatment errors, or any harm arising from a clinic visit.
11. Limitation of liability
To the fullest extent permitted by Indian law, our total liability for any claim arising out of or relating to the service is limited to the fees you paid us in the 12 months preceding the claim, or ₹10,000, whichever is lower. We are not liable for indirect, incidental, or consequential damages including lost revenue, lost patients, or reputational harm.
12. Termination
Either party may terminate this agreement at any time:
- Patients can stop using the bot anytime; just stop messaging it or block the number
- Clinics can cancel their subscription via email; access continues until the end of the paid period
- We may terminate access for violation of these Terms or non-payment, with reasonable notice
On termination, your data will be handled per our Privacy Policy retention periods. You may request earlier deletion via our data deletion process.
13. Intellectual property
The DocPing software, brand, design, and content are owned by Aniket Pathak. You receive a limited, non-exclusive, non-transferable license to use the service per these Terms. You retain ownership of any data you submit (your patient list, appointments, notes); we hold a license only to the extent needed to operate the service.
14. Indemnification
You agree to indemnify us against claims arising from your misuse of the service, your breach of these Terms, or your violation of any law or third-party right.
15. Governing law & jurisdiction
These Terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts at Pune, Maharashtra. Before going to court, the parties agree to attempt good-faith resolution by email or WhatsApp for at least 30 days.
16. Changes to these Terms
We may update these Terms occasionally. Material changes will be communicated via WhatsApp to active users at least 14 days before they take effect. Continued use of the service after the change constitutes acceptance.
